Objection to Text and Data Mining by Artificial Intelligence

The structure of this Site, as well as all audiovisual works and content available on the Site, along with all their components (text, graphics, symbols, signals, sounds, images, etc.), are protected by intellectual property law and cannot be used without prior written authorization from Banijay Kids and Family.

By this notice, Banijay Kids and Family opposes any digital copying or reproduction of these audiovisual works, content, and/or any of their components protected by copyright (text, graphics, symbols, signals, sounds, images, etc.) for the purposes of text and data mining, particularly through the use of an Artificial Intelligence (AI) system, as defined by Articles L. 122-5-3, III and L. 211-3, 8° of the French Intellectual Property Code (CPI), which implements Directive (EU) 2019/790 of April 17, 2019, on copyright and related rights in the Digital Single Market.

Article R. 122-28 of the CPI explicitly states that such objection “does not need to be justified and can be expressed by any means. For content made available to the public online, this objection can be expressed, in particular, through machine-readable methods, including metadata, and by including it in the general terms of use of a website or service.”

It is further noted that, in the context of its activities, Banijay Kids and Family may grant its contractors and/or online press services permission to use the audiovisual works, content, and/or any of their components protected by copyright (text, graphics, symbols, signals, sounds, images, etc.) present on the Site, strictly to the extent necessary for authorized use. However, such permissions do not grant these contractors and/or online press services the right to make digital copies or reproductions of these works, content, and/or their components for text and data mining purposes, nor to authorize any third party, including AI systems, to do so.

Consequently, any text and data mining operations carried out by an AI system using the audiovisual works, content, and/or any of their components protected by copyright (text, graphics, symbols, signals, sounds, images, etc.) available or made accessible online on this Site or by third parties—whether provided in part or in full, freely accessible or behind a paywall—constitute acts of infringement subject to penalties provided under Articles L. 331-1 and subsequent articles of the CPI, unless prior written authorization is obtained from XXX (or, where applicable, from the collective management organization to which XXX has expressly granted a mandate).
